SURPLUS REAL ESTATE AUCTION

The Town of Trent has declared the former City Building as Surplus Property and will offer the following real property at Public Auction located at 104 W. 3rd St. in Trent, SD (Directly East of Steve’s Bar). From the Trent SD Exit #104 – 5 miles east.

Due to deterioration and roof issues with portions of the building formerly utilized as the Office & Shop/Storage Building for the Town of Trent, SD, they have vacated this property and have made the decision to declare it as Surplus Property and will offer the property at Public Auction. The property consists of a building which is approximately 51’ x 100’ with a finished 13 ½’ x 18’ front office area and a   9 ½’ x 12 ½’ single office, additionally there is a finished restroom.  The shop portion of the building consists of 2 stalls with a 12’x12’ OH door in the front (south end of the bldg.) and a 11’x16’ OH door in the east side of the rear portion of the building. The property is serviced by Ottertail Electric, Big Sioux Community Water and Trent Sewer.  The property has 110 amp breaker electric as well as an older Janitorial Furnace.  According to Moody County Assessor’s information the lot is approx. 51’x150’ and the building in its entirety is approx. 51’x100’ & is built with concrete block. This property is condemned, in need of substantial renovation & repair or complete removal for future development and is sold “AS IS, WHERE IS”.  The buyer assumes all risk of repair or removal of the building.   The future use of this property is subject to any Town of Trent and/or Moody County Zoning ordinances.

TERMS:  Cash – A 15% nonrefundable earnest money payment on sale day with balance on or before April 1. 2021. Marketable Title will be conveyed and an Owner’s title insurance policy will be provided with the cost to be divided 50/50 between the buyer and seller.  As this property has been under ownership of the Town of Trent there is no current assessment on the property, therefore there is no current real estate tax amount available. Any taxes going forward will be the sole responsibility of the purchaser(s).  There is an Engineer’s Report as completed by APEX Structural Design, LLC that is available for review upon request from the Town of Trent Finance Officer – ph. 605-428-5160.  The Engineer’s report indicates the building is in a state of progressive failure and does not appear to be safe for human occupancy and does not comply with the structural performance mandates of the current International Building Code; that the overall condition of the building is poor and that structural wood framing, exterior masonary walls and claddings are deteriorated.  In addition, any purchaser assumes the risk of injury to himself, his agents, licensees, assigns, neighborhood property owners, or any other third parties given the information in the engineers report, that among other things the building is not safe for human occupancy and is in a state of progressive failure, which could result in injury or death to those in, on, or around the building; that the character of the risks must be appreciated; and that any purchaser voluntarily accepts these risks and has time, knowledge and experience to make an intelligent choice in any purchase,  This property is being sold with the understanding that the purchaser shall either repair and upgrade the structure, or remove the structure at their expense; if the property is not repaired to the satisfaction of the Town of Trent Board, they will retain the right of condemnation or other recourse available under SD law. This property is sold in “AS IS” condition with no contingencies whatsoever, and the merchantability or suitability of this property for any particular purpose is not guaranteed.  The Purchase Agreement to be signed by a successful bidder will include assumption of all risks by the purchaser and an indemnification clause holding the town of Trent harmless against any and all claims, demands, costs and expenses arising from the repair or destruction of the building by the successful bidder, its agents, licensees or assigns.  This property is sold subject to any Town of Trent and/or Moody County Zoning Ordinances, as well as subject any existing easements, restrictions or reservations of record, if any.  RE Licensees/Auctioneers are acting solely as agents for the sellers.
