AUCTIONEER’S NOTE: Due to the multi-fractioned ownership in this land the Heirs of Ivan & Lois Oyen have made the decision to offer this property at public auction. This auction presents the opportunity to purchase land that has been in the Oyen Family since homesteaded by Ingebrigt Oyen in 1875. This land is extremely well located near Crooks, SD and is bordered on the north by a county oil highway and is situated in Benton Township, which is a highly regarded agricultural area and is a location where rural housing sites are in high demand in Minnehaha County, SD, and is an area where land ownership is especially tightly held and seldom becomes available for sale on the open market. This auction presents the opportunity to purchase parcels of land suitable for utilization with a row crop farming operation, livestock operation or crop/livestock operation, as Parcel #1 is nearly all tillable and Parcel #2 is virtually all pastureland. Parcel #1 is a parcel which surveyed to contain a total of 101.48 acres, which according to FSA information appears to contain approx. 99.15 acres of cropland , while Parcel #2 is virtually all grassland pasture; the FSA information presently includes some additional cropland acres that are part of the acreage site of Monte Oyen who is also one of the owners of the land being sold, thus the FSA information will be subject to an FSA reconstitution subsequent to the sale of the land, although currently the FSA information is combined on +/-149.95 acres that includes 10.95 acres located west of the Oyen acreage that is not part of the property being sold, hence a slight adjustment in the cropland, yields and bases will be required – although presently this land as a 149.95 acre parcel has approx. 109.75 acres of cropland (+/-99.15 acres of cropland on the portion being sold within Parcel #1) with a current 50.95 acre corn base with a 144 bu. PLC yield and a 50.95 acre soybean base with a 43 bu. PLC yield, with the understanding that this information will be subject to an adjustment and a FSA reconstitution to determine the actual bases, yields and cropland assigned to the land being sold; currently this farm is enrolled in the County ARC Election of the USDA farm program. According to information obtained from Surety Agri-Data Inc. it indicates the soils productivity indexes on Parcel #1 are 74.7 with a gently rolling to rolling topography; on Parcel #2 are 41.1 with a level and somewhat low lying topography is areas along the Willow Creek and drainage; and overall Parcels #1 & #2 has a 66.9 soil index. Information obtained from the M’haha. Co. NRCS indicates that no certified wetland determination has been completed on this land. According to Minnehaha County Planning & Zoning the area included in Parcel #1 has 2 remaining rural housing eligibilities with 1 available in the NE ¼ NE ¼ and 1 by conditional use in the SW ¼ NE ¼. The 2021 RE taxes payable in 2022 on a larger 145.31 acres were $2,974.44 or approx. $20.47 per acre.

TERMS: Cash – A 10% nonrefundable earnest money payment on the day of the sale with the balance on or before January 27, 2023, with possession subsequent to the harvest of the 2022 standing crops and the rights of the current tenant to harvest the 2022 crops. Marketable Title will be conveyed and owner’s title insurance policies will be provided with the cost of both the owner’s policy and closing agent’s fee – if any, divided 50-50 between the buyer & seller. This property is being sold based on the acres as stated on a recent survey as completed by Midwest Land Surveying, Inc., with acres understood to be more or less.
