FARM #1: +/-123.60 Surveyed Acres – SALE SITE – Located as described above – LEGAL DESC.:  The SW ¼ of Sec. 8, T. 101N., R, 47W., Except the West 399.6′ of the S. 1,359.5′ and except Jensen’s Tract 1 contained therein, (Valley Springs Twp.), Minnehaha County, SD – Containing 123.60 Acres M/L.

This +/-123.60 acre farm will be offered as Single Unit.   According to Minnehaha County Planning and Zoning Farm #1 has a “No Remaining” rural housing eligibilities.   This property has been surveyed, as the acres on the county tax records appear to be understated, as according to FSA information this property has approx. 121.86 acres of cropland with an FSA 62.3 acre corn base with a 146 bu. PLC yield and a 58.7 acre soybean base with a 43 bu. TERMS:  Cash – A 10% non-refundable earnest money payment on the day of the sale and the balance on or before January 28, 2022 with landlord’s possession subject to the existing farm lease for the 2022 crop year.  Marketable title will be conveyed with an owners title insurance policy provided with the cost divided 50-50 between the buyer and seller, additionally a title company closing fee will be divided 50-50 between the buyer and seller.  All of the 2021 RE taxes payable in 2022 will be paid by the sellers.  All of these properties are sold in accordance with recent surveys as completed by Midwest Land Surveying, Inc, with the acres understood to be “more or less”.  The sellers do not warranty or guarantee that the existing fences lie on the on the true and correct boundary and new fencing, if any, will be the responsibility of the purchaser pursuant to  SD law.  FSA cropland, yields, bases & other information is estimated and not guaranteed and are subject to county committee approval.  The buyer(s) of Farms #2 & #3 will be obligated to comply with the remaining terms and provisions of the existing CRP contract which expire in 2028, with the buyer to be liable for any penalties for noncompliance in the years subsequent to closing.
