TERMS:  Cash – A 10% non-refundable downpayment on the day of the sale on each parcel and the balance on or before February 8, 2019 with full possession of the farmstead/acreage at closing and for possession of the land (Tract “B”) at closing and for the 2019 crop year and/or construction season.  A Warranty Deed(s) will be conveyed and Owner’s Title Insurance provided through Brookings County Title Company, with the cost of the owner’s policy divided 50-50.  A closing agent’s fee (Brookings County Title Co.), if any, to be divided 50-50 between the buyer and seller.  According to the Brookings Co. Treasurer the 2017 RE taxes payable in 2018 on this land were based on a +/-309 acre parcel inclusive of the farmstead and were $7,101.54 and those taxes have been paid by the sellers; additionally all of the 2018 RE taxes payable in 2019 will be paid by the seller.  The acres in this property are to be based on the acres as determined by a survey of the property as completed by Civil Design Inc. (CDI), with the acres understood be “more or less” with the survey cost paid by the seller – with Tr. “A” –the acreage to be sold by the total dollar and Tr. “B” to be calculated on a per acre basis; if combined the amounts will be averaged.  The sellers do not warrant or guarantee that existing fences lie on the true & correct boundary, any new fencing or future maintenance of fences is the responsibility of the buyer(s) in accordance with SD law.
