We will offer the following real property at auction, with the auction to be held at the Summit, SD Fire Hall located at the Corner of Maple St. & Sherman Ave. on the Main Street of Summit, SD; located from the Summit/Milbank/Aberdeen Exit #207 on I-29 (Coffee Cup Truck Stop) – ½ mile east on US Hwy. #12 and approx. 4/10ths mile south on Summit Rd/Maple St.

+/-279.50 Acres of High Quality Well Fenced Native & Tame Grass Pasture – The land is located from the Summit/Milbank/Aberdeen Exit #207 on I-29 – Approx. 4 ½ miles west on US Hwy. #12 to Lohre Road, then 6 miles north on Lohre Rd to 136th St., then ½ mile east on 136th St. to the SW corner of the land; or from Enemy Swim, SD – 6 ½ miles east, 1 mile south on Lohre Rd. and ½ mile east on 136th St.

This auction presents an excellent opportunity to purchase land comprised of predominately high quality native grass pasture with excellent fencing.  This land is located in a highly regarded crop-livestock area of eastern Roberts County, SD. This auction presents the opportunity to purchase a desirable parcel of contiguous grassland containing approximately +/-279.50 deeded acres; also presently there is also an adjacent 40 acre parcel of grassland that is leased from the Bureau of Indian Affairs – thus with the combination of the deeded and leased acres, this property has been operated as a +/-319.50 acre grazing unit.  This is a well located parcel of land located within ½ mile of Lohre Road and is bordered on the south and east by township gravel roads and is situated within 11 miles of the Summit Exit on I-29 and is uniquely situated between Owl Lake and Hurricane Lake, which affords some hunting opportunities for deer and waterfowl.  This is a well-managed tract of unpunished grassland that is cross fenced to accommodate a rotational grazing program implemented by the current owner with three pastures on the +/-279.50 acres of deeded land and a 4th pasture with the adjacent leased 40 acres, thus allowing for best management of the grass and a heightened carrying capacity.  Fencing on this property appears to be well above average with the perimeter and cross fencing comprised primarily of a mixture of 4 and 5 barbed wire fencing.  The grazing and management implemented has left this pasture with a good stand of grass remaining after the 2019 grazing season and weed control efforts have left this pasture is very good condition for a future owner.  This land generally has a rolling to somewhat hilly topography and is primarily comprised of mostly upland native grass, along with some tame grass that is located primarily in the western and northwestern portion of the land.  Livestock water is provided by a combination of dugouts, seasonal waterways and Owl Lake that loops into the northwesterly portion of the property.  Pastures with all of the attributes found in this property are uncommon, as this pastureland is in “turn in ready condition” for the 2020 grazing season.  This purchase includes approx. +/-279.70 deeded acres that are subject to a perpetual US Fish & Wildlife Waterfowl Easements, which provides for grazing at any time throughout the year and haying is allowed after July 15th; although row cropping, filling, burning or draining is strictly prohibited under the terms of the easements, along with the other stipulations of the easements (easement copies are available for review upon request).  There is lease on an adjacent 40 acre tract of pastureland that is leased from the Bureau of Indian Affairs that is in effect for 2020 which has been pre-paid by the seller, with the buyer to reimburse the seller for the 2020 lease amount, furthermore there may be a 3 year extension available for 2021, 2022 & 2023 – for details concerning this lease, contact the owner or the auctioneers.  The 2018 RE taxes payable in 2019 on the deeded acres being offered for sale were … $1,356.42.

TERMS:  Cash – A 10% nonrefundable downpayment on the day of the sale and the balance on or before January 29, 2020 with full possession.  A Warranty Deed will be conveyed and Owner’s Title Insurance provided with the cost divided 50-50 between the buyer & seller, also a Title Company Closing Fee, if any, will be divided 50-50. This property is being sold based on the acres as stated on the County Tax Record, with the acres sold understood to be “more or less”. The seller does not warranty or guarantee that existing fences lie on the true & correct boundary, any new fencing or future maintenance of the fences will be the responsibility of the purchaser(s) in accordance with SD law.  All of the pastureland acres on these properties are subject to US Fish & Wildlife Perpetual Waterfowl Easements.  The buyer will be required to reimburse the seller for the pre-paid 40 acre BIA lease in the $1,600.00 for the 2020 lease term, if by mutual consent of the seller & the BIA, that the buyer should desire to lease the BIA land for an additional 3 years – the buyer would be responsible for all future lease payments.  All of the 2019 RE taxes payable in 2020 will be paid by the seller.  The seller may desire to utilize this property in connection with a 1031 tax free exchange and if so, the buyer will agree to cooperate with facilitation of the exchange, although any costs related to the exchange will be paid by the seller.  This property is sold in “AS IS” Condition & the information contained herein is deemed to be correct, but is not guaranteed.
