TERMS:  Cash - A 10% non-refundable downpayment on the day of the sale and the balance on or before  November 12, 2008 with landlord’s possession, subject to the rights of the current farm tenant for the 2008 crop year.  All of the 2007 RE taxes payable in 2008 as well as all of the 2008 RE taxes payable in 2009 will be paid by the sellers.  The seller will retain all of the 2008 CRP payments & cash rents; with the buyer to receive 100% of 2009 CRP Payments and any or all future rents.  The new owner(s) will be obligated to comply with all the remaining terms and provisions of the existing CRP contracts; any penalty for failure to comply and/or penalties or costs related to early cancellation of these contracts will be the responsibility of the new owner(s).  The acres sold are based on the acres stated on the county tax record, with the understanding that the acres stated are “more or less.” This property is sold as agricultural land under present Lincoln County Zoning.  Any future zoning is subject to Tea City and/or Lincoln County Planning and Zoning and approval of a comprehensive development plan.
